TERMS OF SERVICE

Welcome to Arch Ann. These Terms of Service (“Terms”) govern your use of arch-ann.com (the “Site”) and any purchases made through the Site. Throughout these Terms, “Arch Ann,” “we,” “us,” and “our” refer to Arch Ann LLC.

By accessing the Site, placing an order, or purchasing any product or service from Arch Ann, you agree to these Terms. If you do not agree to these Terms, please do not use the Site or purchase our products or services.

1. ONLINE STORE TERMS

By using this Site or placing an order, you represent that you are legally capable of entering into a binding agreement or that you are using the Site with the permission of a parent or legal guardian.

You may not use our products, artwork, images, or Site for any unlawful or unauthorized purpose.

We reserve the right to refuse service, cancel orders, limit quantities, or restrict access to the Site at our discretion, including in cases of suspected fraud, unauthorized resale, or misuse of our intellectual property.

2. ARTWORK AND PRODUCTS

Arch Ann sells original artwork, art prints, framed artwork, custom artwork, commissions, and other art-related products.

We make every effort to display artwork, colors, textures, dimensions, frames, and materials as accurately as possible. However, colors and appearance may vary depending on your screen, device settings, lighting, printing process, materials, and the handmade nature of certain products.

Product photographs, styled photographs, room mockups, and digital renderings may be used to demonstrate scale, framing, or styling. These images are intended for visualization purposes and may not perfectly represent the appearance or scale of a product in your space.

Dimensions listed on the Site are approximate unless expressly stated otherwise.

Original artwork is inherently unique and may contain variations in texture, brushwork, surface, edges, and finish. These characteristics are part of the artwork and are not considered defects.

3. PRINTS AND FRAMED PRINTS

Certain prints and framed products may be produced, fulfilled, framed, packaged, or shipped by third-party production partners.

Minor variations in printing, paper, matting, framing, mounting, cropping, or finishing may occur as a result of the production process.

Frame dimensions may refer to the overall finished size rather than the artwork or image size. Customers are responsible for reviewing the dimensions provided on the applicable product page before purchasing.

4. ORIGINAL ARTWORK

All original artwork is sold as a one-of-a-kind work unless otherwise stated.

Once an original artwork has been purchased, ownership of the physical artwork transfers to the purchaser after full payment has been received. Purchasing an original artwork does not transfer copyright, reproduction rights, licensing rights, or other intellectual property rights.

Arch Ann and/or the artist retain all intellectual property rights in the artwork.

5. CUSTOM ARTWORK AND COMMISSIONS

Custom artwork and commissions may be subject to additional terms provided in a commission agreement, proposal, invoice, product description, or other written agreement.

Where additional commission terms are provided, those terms are incorporated into these Terms and will control with respect to the commission if there is a conflict.

Unless otherwise agreed in writing:

Deposits and payments toward custom artwork are non-refundable once work has begun.
Estimated completion dates are estimates and are not guaranteed delivery dates.
Artistic decisions remain within the discretion of the artist.
Reasonable variation from reference photographs, inspiration images, mockups, or preliminary concepts is expected.
Revisions outside the agreed scope may require an additional fee.
Final artwork will not be delivered until all amounts due have been paid.

Commissioning artwork does not transfer copyright or reproduction rights to the client unless a separate written licensing or copyright agreement expressly states otherwise.

6. INTELLECTUAL PROPERTY

All artwork, photographs, designs, graphics, product images, written content, logos, branding, videos, and other materials displayed on the Site are owned by or licensed to Arch Ann and are protected by applicable copyright, trademark, and intellectual property laws.

Purchasing artwork gives you ownership of the physical item purchased only.

Unless you receive prior written permission from Arch Ann, you may not reproduce, copy, scan, photograph for commercial reproduction, distribute, modify, sell reproductions of, create derivative products from, license, commercially exploit, or otherwise use Arch Ann artwork or imagery.

This includes, without limitation, using artwork on prints, apparel, merchandise, websites, advertising, digital products, social media content for commercial purposes, or AI training datasets.

Personal display and enjoyment of purchased artwork is permitted.

7. ARTWORK IMAGES AND PROMOTIONAL USE

Unless otherwise agreed in writing, Arch Ann retains the right to photograph and reproduce images of artwork created by Arch Ann, including commissioned artwork, for portfolios, websites, social media, exhibitions, publications, marketing, prints, licensing, and other promotional or commercial purposes.

Any confidentiality or exclusivity requirements for commissioned artwork must be agreed to in writing before the commission begins.

8. PRICING AND PAYMENT

Prices are listed in U.S. dollars unless otherwise stated.

We reserve the right to change prices at any time without notice. A price change will not affect an order that has already been accepted and paid for.

Applicable taxes, shipping charges, duties, and other fees may be added at checkout.

We reserve the right to correct pricing errors, product information errors, or other inaccuracies. If an error affects an order you have already placed, we may contact you to provide the option to proceed under the corrected terms or cancel the affected portion of the order for a refund.

9. ORDERS

Submitting an order does not guarantee acceptance.

We reserve the right to cancel or refuse an order for reasons including suspected fraud, pricing or inventory errors, product unavailability, unauthorized resale, or circumstances outside our reasonable control.

If we cancel an order after payment has been processed, we will refund the amount paid for the cancelled item or order.

10. SHIPPING AND DELIVERY

Processing and shipping estimates provided on the Site are estimates only and are not guaranteed.

Arch Ann is not responsible for delays caused by shipping carriers, weather, natural disasters, customs, incorrect addresses supplied by customers, or other circumstances outside our reasonable control.

Customers are responsible for providing a complete and accurate shipping address at checkout.

Additional shipping terms may be contained in our Shipping or Refund Policy.

11. DAMAGED OR LOST ORDERS

If artwork arrives damaged, please contact us promptly using the contact information provided on the Site and include photographs of:

the artwork or product;
the shipping box or packaging;
the shipping label; and
the damaged areas.

Customers should retain all original packaging until the claim has been resolved.

Claims involving damaged, lost, or missing shipments may require cooperation with the applicable shipping carrier or fulfillment partner.

Our available remedies may include replacement, repair, store credit, or refund depending on the circumstances and availability of the artwork.

Original artwork may not be replaceable with an identical item.

12. RETURNS, REFUNDS, AND CANCELLATIONS

Returns, refunds, exchanges, and cancellations are governed by our Refund Policy available on the Site.

Certain products, including original artwork, custom artwork, commissioned artwork, personalized items, made-to-order products, and certain framed products are final sale or otherwise ineligible for return as described in the applicable product listing or Refund Policy.

Nothing in these Terms limits any rights that cannot legally be waived under applicable law.

13. PERSONAL USE AND RESALE

Products purchased through the Site are intended for personal use and not for commercial reproduction.

We reserve the right to limit or cancel orders that appear to be placed for unauthorized resale or reproduction.

Resale of a lawfully purchased physical artwork does not grant the reseller any copyright, reproduction, licensing, or other intellectual property rights in the artwork.

14. THIRD-PARTY SERVICES

The Site may use or link to third-party services, including payment processors, fulfillment providers, shipping carriers, social media platforms, and other service providers.

Your use of third-party services may be subject to separate terms and privacy policies.

Arch Ann is not responsible for the content, availability, policies, or actions of third-party websites or services except to the extent required by applicable law.

15. PROHIBITED USES

You may not use the Site or its content to:

violate applicable laws or regulations;
infringe our intellectual property rights or the rights of others;
reproduce or commercially exploit our artwork without authorization;
submit false or misleading information;
transmit malicious code or interfere with the Site;
scrape, harvest, or systematically collect Site content without permission;
impersonate another person or entity;
engage in fraudulent activity; or
use our artwork, images, or content to develop, train, fine-tune, or improve artificial intelligence or machine-learning systems without our express written permission.

We may terminate or restrict access to the Site for violations of these Terms.

16. DISCLAIMER OF WARRANTIES

To the fullest extent permitted by applicable law, the Site and its content are provided on an “as is” and “as available” basis.

We do not guarantee that the Site will always be uninterrupted, secure, or error-free.

Nothing in this section limits warranties or protections that cannot legally be excluded.

17. LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, Arch Ann and its owners, employees, contractors, affiliates, and service providers will not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or purchase of products.

To the fullest extent permitted by law, Arch Ann's total liability arising from a particular purchase will not exceed the amount you paid to Arch Ann for the product or service giving rise to the claim.

Nothing in these Terms excludes liability that cannot legally be limited or excluded.

18. INDEMNIFICATION

To the extent permitted by law, you agree to indemnify and hold harmless Arch Ann and its owners, employees, contractors, affiliates, and service providers from claims, losses, liabilities, and reasonable expenses arising from your violation of these Terms, misuse of the Site, or infringement of another party's rights.

19. PRIVACY

Your use of the Site is also subject to our Privacy Policy.

Please review the Privacy Policy to understand how information may be collected, used, and disclosed when you use the Site or make a purchase.

20. GOVERNING LAW

These Terms and any dispute arising from your use of the Site or purchase from Arch Ann will be governed by the laws of the State of Texas, without regard to conflict-of-law principles.

Any dispute shall be brought in a court of competent jurisdiction in Texas, unless applicable law requires otherwise.

21. SEVERABILITY

If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by law and the remaining provisions will remain in effect.

22. CHANGES TO THESE TERMS

We may update these Terms periodically.

Changes will become effective when posted to the Site unless otherwise stated. The “Last updated” date at the top of this page indicates when these Terms were most recently revised.

Your continued use of the Site following an update constitutes acceptance of the revised Terms to the extent permitted by law.

23. ENTIRE AGREEMENT

These Terms, together with our Privacy Policy, Refund Policy, applicable product descriptions, and any additional written agreement relating to a custom order or commission, constitute the agreement between you and Arch Ann regarding your use of the Site and purchases from us.
